Terms of Service
By using EveStay you agree to these terms. If you do not agree, do not use the service. This document is a product-facing summary for early launch and should be reviewed by counsel before large-scale commercial launch.
1. The service
EveStay provides AI companion experiences (chat, optional voice/selfies, memory, and related features) for adults. Companions are AI systems. They are not human partners, therapists, emergency services, or licensed professionals.
2. Age requirement
You must be 18 or older. We may terminate access if we believe you are underage.
3. Accounts
You may begin anonymously and later attach an email or other sign-in method. You are responsible for activity under your account and for keeping credentials secure.
4. One relationship
Launch product rules allow one active relationship at a time. Changing companion may end the previous active relationship; historical chat may be retained only as described in product UI.
5. Acceptable use
- No illegal activity, exploitation, or attempts to harm others.
- No attempts to obtain sexual content involving minors (zero tolerance).
- No reverse engineering, scraping, or abusing rate limits in a way that harms the service.
- No using EveStay to impersonate real people or commit fraud.
The product is designed for companionship with mild romance/affection; explicit pornography and prohibited sexual content are not allowed.
6. AI limitations & safety
AI can be wrong, inconsistent, or inappropriate. Do not rely on it for medical, legal, financial, or crisis decisions. If you are in crisis, contact local emergency services or resources such as IASP resources. The product may pause flirtation and upgrades in crisis-related contexts.
7. Subscriptions & billing
- Paid plans are billed through Stripe (or another stated processor).
- Prices shown in-product control the offer (for example first-month intro, then standard monthly, annual, or Lite).
- Unless stated otherwise, subscriptions renew until cancelled.
- Cancel anytime via Customer Portal or support; access continues until the end of the paid period unless stated otherwise.
8. Refunds
Refund requests are handled case-by-case for the early service period, subject to Stripe and applicable law (including any cooling-off rights that may apply in your region). Contact support promptly with your account email and approximate purchase time at support@evestay.com.
9. Intellectual property
EveStay branding, product software, and default character assets are owned by us or our licensors. You retain rights to your own inputs, subject to the license needed for us to operate the service.
10. Media & AI-generated content
Selfies and other generative media may be synthetic and should be treated as AI-generated. Free-tier media may be preset; paid media may be contextual generation under quota limits.
11. Optional Telegram
Telegram is optional. Connecting it is never required to complete payment or continue web chat. You can disconnect at any time from product settings where available.
12. Disclaimers
The service is provided “as is” to the fullest extent permitted by law. We disclaim warranties of uninterrupted access, fitness for a particular purpose, and non-infringement where allowed.
13. Limitation of liability
To the fullest extent permitted by law, EveStay’s total liability for claims relating to the service is limited to the amounts you paid us for the service in the three months before the claim.
14. Changes & termination
We may update features and these terms. We may suspend or terminate accounts that violate these terms or create risk for users or the platform.
